NAIC Issues Three White Papers on Exchanges: Adverse Selection Draft Open for Comment

he Exchanges Subgroup of the National Association of Insurance Commissioners (NAIC)’s Health Insurance and Managed Care Committee has issued three draft white papers on health insurance exchanges: The first of the three papers addresses the comparative roles of “Navigators” (as established in ACA §1311(i), 42 USC §18031(i)) and “Producers” (i.e., agents and brokers) in an exchange; the second paper explores exchange financing issues; and the third paper looks at the possibility of adverse selection in exchanges. 

These papers do not aim to provide specific recommendations to states.  Rather, according to NAIC, the papers aim to provide a broad outline of the relevant issues so that states will know what their options are and what considerations they should keep in mind as they develop their exchanges. 

The adverse selection draft is currently open for comment, and a fourth draft paper on exchange governance is pending.  Comments can be e-mailed to Jolie Matthews at jmatthew@naic.org.
